1.              Information Collected 

1.1           Boutique Connection collect personally identifiable information from its customers and others (such as name and email address, personal choices) when you use the Website, or become involved with Boutique Connection through our social media accounts. Non-personally identifiable information may also be collected about you through Boutique Connection’s use of cookies to enable efficient operation of the Website or any of our social media accounts or also to collect log file information automatically during your use of the Website or social media accounts, or asking you to provide certain non-personally identifiable information about yourself, such as your age, in filling out a registration form.

1.2           Boutique Connection will not collect information from children under the age of eighteen (18) years of age.  When information is received that is considered to be from a child less than eighteen (18) years of age, the child’s parent or guardian if their email address is known, will receive an email alerting them to the child’s use of the Website or the applicable social media account and if the child has registered themselves as a contact person on the Website the method by which, their contact registration details can be deleted.

2.              Use of Information

2.1           Boutique Connection will only use the information you provide to us for the purpose for which such information was provided.  Boutique Connection may use information to deliver to you information about Boutique Connection promotional material and for assistance in detection and site administration.  Your information may also be used to contact you when necessary and may be shared with other companies that may want to contact you with offers consistent with your stated preferences.  Customers may opt-out of receiving future mailings from Boutique Connection and other entities by advising Boutique Connection via email that they do not wish to receive such information.

4.2           Boutique Connection may use an outside advertisement server company to display ads on Website or any of our social media accounts, these ads may contain cookies.  The advertisement server company may collect cookies received with outside banner ads.  Boutique Connection do not have access to information that would confirm the use of cookies by the advertisement server company.

5.1           The Website and our social media accounts have industry standard security measures in place to protect the loss, misuse and alteration of the information under our control.  While there is no such thing as perfect security on the Internet, Boutique Connection will take all reasonable steps to ensure the safety of your personal information. This is not a guarantee that your information may be lost, misused or altered and Boutique Connection cannot guarantee or warrant the security of the information you transmit to Boutique Connection.  If there is a security breach Boutique Connection will post information on Website.

6.1           The Website contains links to other Websites.  Boutique Connection is not responsible for the privacy practices or the content of other Websites you may use.

7.              Correction Update

7.1           Boutique Connection allows its customers to change or modify information previously provided.  This may be done through the methods outlined on the Website and in respect of our social media accounts. Unfortunately, to the extent that such information is also stored in other databases, Boutique Connection cannot always ensure that such changes or modifications will reach other databases.  Boutique Connection will use all reasonable efforts to ensure that your information is changed or modified in Boutique Connection records.

8.1           You may opt-out of receiving communications from our partners and from Boutique Connection, by letting us know via email.

9.1           The Website is hosted in New Zealand.  You acknowledge and agree that in continuing your use of the Website, this Privacy Notice and Boutique connections terms of use are governed by New Zealand law and you submit to the non-exclusive jurisdiction of the High Court of New Zealand.  You further agree you are transferring your personal information to Boutique Connection servers and that you irrevocably consent to such transfer.

10.1        Where Boutique Connection is acquired by or merged with a third party, we reserve the right to transfer and assign the information collected to the new purchaser.

10.2        Where Boutique Connection is placed into receivership, liquidation or management by any third party, Boutique Connection cannot guarantee how your information will be dealt with.

11.           Limitation of Liability

11.1        In no event shall Boutique Connection, its subsidiaries and affiliates, their respective officers, directors, employees, or agents, be liable to you for any direct, indirect, incidental, special, punitive or consequential damages whatsoever resulting from any errors, mistakes, or inaccuracies of content, personal injury or property damage, of any nature whatsoever, resulting from your access to and use of the website, unauthorised access to or use of servers and/or any and all information stored, any interruption or cessation of transmission to or from the Website or any of our social media accounts, any bugs, viruses, or other harmful components which may be transmitted to or through our Website by any third party, and/or any errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available via the Website or on any of our social media accounts, whether based on warranty, contract, tort or otherwise or whether or not the company is advised of the possibility of such damages.  The foregoing limitation of liability shall apply to the fullest extent permitted by law.

11.2        If Boutique Connection are found liable for any liability arising under the Privacy Notice to the extent allowable at law you agree that Boutique Connections total cumulative liability shall not exceed the sum of NZ$5,000.00.
